Australian consumer law stage 2

Corporate reporting reforms

The Corporations Amendment (Corporate Reporting Reform) Act 2010 has passed into law. The Act imposes a new solvency based test for the payment of company dividends and introduces a number of new measures to improve the quality and reduce the regulatory burden of financial reporting. Simplified PDS regulations

Amendments have been made to the Corporations Regulations 2001 to prescribe the form and contents of short and simplified product disclosure statements for margin loans, superannuation products and simple managed investment schemes. Superannuation borrowing arrangements

The Government has published a consultation draft of regulations providing that certain limited recourse borrowing arrangements will be treated as 'financial products' under the Corporations Act when entered into by regulated superannuation funds. The draft regulations can be viewed at:

APRA - policy - general insurers

APRA has released its response to submissions and final prudential standards to simplify the prudential reporting requirements for general insurers. They are available on APRA’s website at:
